Terms of Service

1. Acceptance of Terms

By accessing or using the Emancip8 platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Emancip8 is a trading name of LIVEMONEY (Pty) Ltd (Reg No: 2023/542782/07), a private company registered in South Africa. These Terms are governed by the laws of the Republic of South Africa.

2. Description of Service

Emancip8 provides an AI-powered Executive Assistant platform. Users can create and customise AI assistants that integrate with their business tools and workflows. The Service is available on a subscription basis with tiered pricing.

3. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain and update your account information as needed
• Keep your account credentials confidential
• Notify us immediately of any unauthorised use of your account
• Be responsible for all activity that occurs under your account

You must be at least 18 years old to use the Service. By creating an account, you confirm that you are of legal age to enter into a binding contract.

4. Subscriptions & Payments

Paid subscriptions are billed monthly or annually as selected during sign-up. All payments are processed securely through Paystack, our payment partner.

• Subscription fees are charged in South African Rand (ZAR)
• Fees are non-refundable except as expressly stated in these Terms
• We reserve the right to change our pricing with 30 days' notice
• Non-payment may result in suspension or termination of your account
• All prices exclude VAT and applicable taxes, which will be added at checkout

5. Cancellation & Refunds

You may cancel your subscription at any time through your account settings. Upon cancellation:

• Your subscription remains active until the end of the current billing period
• You will not be charged for subsequent periods
• No refunds are provided for partial billing periods
• Your data will be retained for 30 days after cancellation, during which you can reactivate
• After 30 days, your data will be permanently deleted in accordance with our Privacy Policy

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Infringe the intellectual property rights of others
• Distribute malware, viruses, or other harmful code
• Interfere with or disrupt the integrity of the Service
• Attempt to gain unauthorised access to any part of the Service
• Use the Service for any unlawful or fraudulent purpose
• Generate content that is harmful, threatening, abusive, or discriminatory

7. Intellectual Property

The Service, including its code, design, branding, and proprietary technology, is owned by LIVEMONEY (Pty) Ltd and is protected by South African and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your business purposes during your subscription period.

You retain all rights to the data, content, and information you provide to your AI Executive Assistant. We do not claim ownership of your data.

8. Data Protection & Privacy

Our collection, use, and protection of your personal information is governed by our Privacy Policy, which forms part of these Terms. We process your data in accordance with the Protection of Personal Information Act (POPIA).

9. Limitation of Liability

To the maximum extent permitted by South African law, LIVEMONEY (Pty) Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that AI Assistant outputs will be accurate, complete, or appropriate for your specific circumstances. AI-generated content should be reviewed before use in professional contexts.

11. Termination

We may suspend or terminate your access to the Service if you violate these Terms or if your use of the Service poses a security risk or legal liability to us or other users.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the platform. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Gauteng, South Africa.
